These Terms of Use ("Terms") govern your access to and use of the HerSets app and related services (the "Service"), operated by OLROM LLC, a California limited liability company. By creating an account or using HerSets, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use HerSets. If you are under 18, you confirm you have a parent or guardian's permission to use the Service. By using HerSets, you represent that you meet these requirements and that all registration information you provide is accurate.

2. Your Account

• You're responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• Notify us immediately at support@hersets.com if you suspect unauthorized use of your account.
• You may only create one account per person unless we approve otherwise.

3. Your Content

You retain ownership of the photos, outfits, and other content you upload to HerSets ("User Content"). By posting User Content, you grant HerSets a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely to operate and improve the Service (for example, showing your closet back to you, or displaying content you choose to share publicly).

You're responsible for your User Content and confirm you have the rights to share it. Don't upload content that infringes someone else's rights, is unlawful, or violates these Terms.

4. Prohibited Conduct

When using HerSets, you agree not to:

• Upload content that is illegal, infringing, harassing, hateful, sexually explicit involving minors, or otherwise harmful.
• Impersonate another person or misrepresent your affiliation with anyone.
• Attempt to access another user's account or interfere with the security of the Service.
• Scrape, reverse-engineer, or use automated tools to access the Service beyond normal use.
• Use HerSets for any commercial purpose we haven't authorized.
• Upload viruses, malware, or attempt to disrupt the Service.

5. SMS Appointment Reminders

5.1 Feature description

HerSets provides a built-in SMS appointment reminder feature that allows you, as a beauty artist, to send automated text message reminders to your clients about upcoming appointments. SMS messages are delivered through Infobip, our third-party SMS provider.

5.2 Your responsibilities as the sender

By using the SMS reminder feature, you represent, warrant, and agree that:

• You have obtained each recipient's prior express written consent to receive SMS messages from you before sending any message through HerSets. This includes disclosing to each client: (a) that they are consenting to receive text messages, (b) the nature of the messages (appointment reminders), (c) that message and data rates may apply, and (d) how to opt out.
• You will only send appointment reminder messages — not unsolicited marketing, promotional, or other non-transactional content — through the SMS feature.
• You will maintain records of consent and honor all opt-out requests promptly.
• You will not add phone numbers to HerSets for SMS without the owner's consent.
• You are the sender of record for all SMS messages sent through your HerSets account and are solely responsible for compliance with all applicable laws, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, CTIA guidelines, and any other federal, state, or local laws governing electronic communications.

5.3 Opt-in requirements

Before sending SMS messages to any client, you must present them with a compliant opt-in disclosure. The following language (or substantially similar language) must be provided to each client:

Consent obtained through this process must not be a condition of receiving services from you. Clients may opt in or decline SMS reminders without affecting your professional relationship with them.

5.4 Opt-out and HELP

• STOP: Any client who replies STOP to an SMS reminder will be immediately opted out and will not receive further messages from your HerSets account. HerSets processes STOP replies automatically.
• HELP: Any client who replies HELP will receive a help message with contact information for support.
• You must not attempt to re-subscribe a client who has opted out without their renewed express written consent.

5.5 Message and data rates

Standard message and data rates may apply to recipients based on their mobile carrier and plan. HerSets is not responsible for any charges incurred by message recipients.

5.6 Carrier disclaimer

Mobile carriers are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to carrier network availability and is not guaranteed.

5.7 HerSets' role

HerSets acts as a technology platform that transmits SMS messages on your behalf. HerSets is not the initiator of message content and is not responsible for your failure to obtain proper consent or comply with applicable law. You agree to indemnify and hold HerSets harmless from any claims, fines, or penalties arising from your use of the SMS feature.

6. Subscriptions and In-App Purchases

• HerSets may offer free and paid features, including subscriptions billed through the Apple App Store or Google Play.
• Purchases are billed and managed by Apple/Google according to their terms; pricing, billing cycles, and cancellation are subject to their policies.
• Subscriptions renew automatically unless canceled at least 24 hours before the renewal date, through your Apple ID or Google Play account settings.
• Refunds are handled by Apple/Google per their refund policies — HerSets cannot directly issue refunds for App Store or Play Store purchases.

7. Intellectual Property

The HerSets name, logo, app design, and underlying software are owned by HerSets and protected by intellectual property laws. These Terms don't grant you any rights to our trademarks or branding beyond what's needed to use the Service as intended.

8. Termination

You may stop using HerSets and delete your account at any time (see our Account Deletion Policy). We may suspend or terminate your account if you violate these Terms, create risk or legal exposure for us, or if required by law, with notice where reasonably possible.

9. Disclaimers

HerSets is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. App features are tools to help you manage your business — HerSets does not guarantee uninterrupted delivery of SMS messages or that message delivery will meet any particular standard.

10. Limitation of Liability

To the fullest extent permitted by law, HerSets and its team are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including any liability arising from SMS messages sent through the platform. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the 12 months before the claim arose.

11. Indemnification

You agree to indemnify and hold HerSets and its officers, employees, and agents harmless from any claims, damages, fines, penalties, or expenses (including attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your failure to obtain proper SMS consent from message recipients or your violation of any applicable law governing electronic communications, including the TCPA.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in California, unless applicable law requires otherwise.

13. Changes to These Terms

We may update these Terms from time to time. We'll notify you of material changes in-app or by email. Continued use of HerSets after changes take effect means you accept the updated Terms.
